Brexit and European Union Trade Marks (EUTMs) and Community Designs (RCDs)

The UK formally left the EU on 31 January 2020. At the end of the transition period that is expected to last until 31 December 2020, EUTMs and RCDs registered at the European Union Intellectual Property Office (EUIPO) will no longer be valid in the UK. However, all registered EUTMs and RCDs will be converted into comparable national UK rights by the UK Intellectual Property Office (IPO) without charge. Filing dates, priority and seniority dates of the original EUTMs and RCDs will be retained.

For EUTM and RCD applications that are still pending when the transition period ends, on the other hand, applications for equivalent UK rights need to be filed and the national application fees paid within nine months if the right is to be upheld in the UK.
